App Terms and Conditions
These terms and conditions ("Terms and Conditions") apply to the use of all Ryco Games LLC ("Ryco Games") mobile applications ("Apps") that post a link to these Terms and Conditions. By downloading or otherwise accessing the Apps you agree to be bound by the following terms and conditions ("Terms"). If you have any queries about the App or these Terms, you can contact us by any of the means set out in paragraph 10 of these Terms. If you do not agree with these Terms, you should stop using the App immediately.
The Ryco Games Apps are made available for your own, personal use. The Apps must not be used for any commercial purpose whatsoever or for any illegal or unauthorized purpose. When you use the App you must comply with all applicable US laws and with any applicable international laws, including the local laws in your country of residence (together referred to as "Applicable Laws"). You agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:
(a) Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or
(b) Attempt to gain unauthorized access to the App or any networks, servers or computer systems connected to the App; or
(c) Modify, adapt, translate or reverse engineer any part of the Apps or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law.
You agree to indemnify Ryco Games in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the Apps otherwise than in accordance with these Terms or Applicable Laws.
The copyright in all material contained on, in, or available through the Apps including all information, data, text, music, sound, and graphics, the selection and arrangement thereof, and all source code, software compilations and other material ("Material") is owned by or licensed to Ryco Games. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without Ryco Games express permission.
You may not use the Apps to publish or distribute any information (including software or other content) which is illegal, which violates or infringes upon the rights of any other person, which is defamatory, abusive, hateful, profane, pornographic, threatening or vulgar, which contains errors, viruses or other harmful components, or which is otherwise actionable at law. Ryco Games may at any time exercise editorial control over the Content of the Site.
The trademarks, service marks, and logos ("Trade Marks") contained on or in the App are owned by Ryco Games. You cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of Ryco Games or the relevant third party partner of Ryco Games.
By installing an UltimateFan app, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the UltimateFan App.
In order to ensure UltimateFan provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please comment within the app or report to support@rycogames.com.
Objectionable Content Policy
We do not control or direct what people and others do or say, and we are not responsible for their actions or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). However, content may be submitted to UltimateFan, who may moderate all content and ultimately decide whether or not to remove a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content.
If you post any Objectionable Content on the Apps, then Ryco Games may take any remedial action that Ryco Games, in its sole discretion, deems necessary and/or appropriate under the circumstances, such as, without limitation, suspending or terminating your Account and/or removing all of your User Content from the Apps. The decision to remove Objectionable Content shall be made at Ryco Games's sole discretion.
Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.
The App may contain links to websites operated by third parties ("Third Party Websites"). Ryco Games does not have any influence or control over any such Third Party Websites and, unless otherwise stated, is not responsible for and does not endorse any Third Party Websites or their availability or contents. When using the Apps, please be aware that mobile service providers set their own prices for data and usage. Ryco Games is not responsible for any data charges incurred as a result of downloading and using the Apps.
USE OF THE APPS ARE AT YOUR OWN RISK. THE APPS ARE PROVIDED ON AN "AS IS" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) RYCO GAMES DISCLAIMS ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IN RELATION TO THE APPS; AND (B) ALL IMPLIED WARRANTIES, TERMS AND CONDITIONS RELATING TO THE APPS (WHETHER IMPLIED BY STATUE, COMMON LAW OR OTHERWISE), INCLUDING (WITHOUT LIMITATION) ANY WARRANTY, TERM OR CONDITION AS TO ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR PURPOSE OR ANY SPECIAL PURPOSE, AVAILABILITY, NON INFRINGEMENT, INFORMATION ACCURACY, INTEROPERABILITY, QUIET ENJOYMENT AND TITLE ARE, AS BETWEEN RYCO GAMES AND YOU, HEREBY EXCLUDED. IN PARTICULAR, BUT WITHOUT PREJUDICE TO THE FOREGOING, WE ACCEPT NO RESPONSIBILITY FOR ANY TECHNICAL FAILURE OF THE INTERNET AND/OR THE APPS; OR ANY DAMAGE OR INJURY TO USERS OR THEIR EQUIPMENT AS A RESULT OF OR RELATING TO THEIR USE OF THE APPS. YOUR STATUTORY RIGHTS ARE NOT AFFECTED.
Ryco Games will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the Apps, for any: (i) economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or (ii) loss of goodwill or reputation; or (iii) special or indirect or consequential loss.
Ryco Games reserves the right to suspend or cease providing any services relating to the apps published by it, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.
We accept no responsibility for adverts contained within the App. If you agree to purchase goods and/or services from any third party who advertises in the Apps, you do so at your own risk. The advertiser, not Ryco Games, is responsible for such goods and/or services and if you have any queries or complaints in relation to them, your only recourse is against the advertiser.
These Terms (as amended from time to time) constitute the entire agreement between you and Ryco Games concerning your use of the Apps. Ryco Games reserves the right to update these Terms from time to time. If it does so, the updated version will be effective immediately, and the current Terms are available through a link in the App Store to this page. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of the Apps. No other variation to these Terms shall be effective unless in writing and signed by an authorised representative on behalf of Ryco Games.
Governing Law and Venue All matters relating to your access to or use of the Apps, including all disputes, shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflicts of law principles. The exclusive jurisdiction and venue with respect to any action or suit arising out of or pertaining to the subject matter hereof shall be the courts of competent jurisdiction located in the State of New Jersey, USA. Any claim arising out of or in connection with your use of or inability to use the Apps or its Content, products or services must be brought within one (1) year after the event or such claim is barred.
Ryco Games failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Ryco Games in writing.
Any information collected from you is subject to our Privacy Policy, which governs the collection and use of that information.
